Art. 2. General
These general terms and conditions govern the use of the website ‘https://ieperfest.com’ and apply to any offer or agreement relating to products or services sold by Ieperfest VZW.
Any deviation from these can only be agreed upon in writing. Even with such written deviation, these general terms and conditions will at least retain their complementary effect for all aspects, not expressly regulated otherwise in writing.
Ieperfest reserves the right to amend these terms and conditions if necessary and therefore recommends that you regularly check these terms and conditions on the website for any changes. Of course, any change will not affect the product or service purchased by you.
Art. 3. Offer
All offers and quotations from Ieperfest VZW, in any form whatsoever, are without obligation unless the offer includes a deadline for acceptance. The products, as offered in the webshop, are available while stocks last.
Are you a consumer? Then you generally have the right to revoke your order within a period of 14 days, without giving reasons. However, applicable European legislation and the Economic Law Code, provide an exception to this right of withdrawal for services related to leisure activities if a certain date or period of performance is foreseen. Tickets for concerts or festivals fall within the scope of this exception. This means that you consequently have no right of withdrawal when you purchase such tickets via our website. More information on the exception to the right of withdrawal for tickets for concerts or festivals can be found on the website of the FPS Economy or the website of the European Consumer Centre.
Art. 4. Fraud / resale tickets & bracelets
Ieperfest VZW is committed to prevent all possible forms of suppression, deception, and fraud, as well as any discrimination related to the access and use of the website. Taking this into account, it denies any responsibility if the customer does not make the payment, or the customer transfers the wrong data at the time of booking one or more services. This is an obligation of means. Ieperfest VZW is not and in no way liable for the fact that certain persons manage to obtain tickets from Ieperfest without the agreement of Ieperfest and subsequently resell those tickets at a higher price. The only way to legally obtain a concert ticket is via https://ieperfest.com.
Each festival ticket is personal. Resale and any trading of festival tickets may result in the invalidation of the tickets, and possible legal prosecution.
Your festival bracelet must not be passed on. Anyone caught defrauding bracelets also exposes themselves to prosecution.
Criminal charges will be filed in case of forging tickets or other festival receipts.
Art. 5. Payment
The price stated on the website at the final bill is determined and payable in euros and includes VAT and other government charges unless expressly stated otherwise. The customer should transfer this price to Ieperfest through the options offered during the online ordering process.
The customer is undoubtedly and solely responsible for the correct and complete execution of the payment and all other details related to this purchase, such as communication of an email address to receive the tickets.
Art. 6. Festival site access
Show your ticket(s) on your smartphone or tablet and exchange them at our festival ticket offices. Or print your ticket(s). You will only be granted access to the site after your ticket has been exchanged for a valid festival bracelet. The ticket is only valid with a readable barcode or receipt.
Art. 7. Force Majeure
Tickets will under no circumstances be taken back, exchanged or refunded. This also applies in case of cancellation and/or force majeure or loss.
If Ieperfest is unable to deliver and/or execute in full or in part, not on time, not properly or has to cancel at any time for one or more reasons of force majeure, then this (full or partial) non-compliance, untimely performance or improper performance cannot be imputed to it. is not liable if a shortcoming is the result of force majeure. Under no circumstances will it owe the customer any compensation.
During the period of force majeure, Ieperfest’s obligations will at least be temporarily suspended. If the force majeure lasts longer than one month, both parties are authorised to dissolve the agreement without judicial intervention, without any obligation to pay damages. Ticket holders will then automatically be refunded the value of their festival ticket. If you have purchased your festival ticket(s), the value of your festival ticket(s) will be refunded to your account, excluding the reservation and transaction costs per ticket. This small amount serves to reimburse external costs for payment transactions and ticketing firms.
The term “force majeure” shall, in any case, mean unforeseeable circumstances, including those of an economic nature, which have arisen through no fault or action on the part of the company, such as inter alia, serious malfunctioning of the company, inevitable cutbacks in production, unforeseeable shortcomings, fire, strikes and lock-outs, both at the company and at subcontractors, pandemic, epidemic, government intervention, government order or government measure, travel ban, war, hostilities, terrorist attacks or threat thereof, state of siege, mobilisation, weather conditions that seriously interfere with the execution of the agreement, either in Belgium or in any other country where any suppliers or booked artists are located.
However, the cancellation of one or more bands beyond the organisation’s control will not give rise to a refund of the ticket or compensation for damages.
Art. 8. Visual content
At the festival, festival visitors may be photographed and/or filmed. From the moment they enter the festival grounds, festival visitors waive their portrait rights. This means that images with the visitors’ portrait may be used for promotional and commercial purposes and/or for security reasons. The foregoing also applies to audio recordings.
Images made by festival visitors on the festival grounds, on the other hand, cannot be used for commercial or public purposes, except with prior written consent from the organisation.
Art. 9. Acceptance
The purchase of a ticket implies that the ticket holder accepts the present general terms and conditions, the festival conditions and the (local) COVID-19 measures and protocols in force.
If the ticket holder does not comply with these aforementioned conditions and measures/protocols, he or she may be denied further access to the festival site.
The ticket holder further participates at his/her own risk in the event to which this ticket gives access and releases the organisation and operator from any liability in case of incidents and/or accidents.
Should any of the aforementioned conditions and measures/protocols prove to be null and void or partially unenforceable, the remaining conditions and measures/protocols shall not be affected and shall retain their full effect minus the disputed clauses to the extent possible. The parties undertake to negotiate in good faith a new clause that will respect the intent of any void clause. The new clause will then replace the clause that was (or could have been) affected by nullity.
Art. 10. Complaints
Any complaints must be sent within 3 (three) days after the observation of the fact that is the subject of the complaint by a registered letter to the address of the organisation (Sint-Jacobsstraat 3, 8900 Ieper) and must be fully motivated and accompanied by all necessary supporting documents. Failing this, Ieperfest VZW reserves the right not to handle the complaint.
